Individuals with Disabilities Education Act (IDEA) 1975
In 1975 Congress passed the Individuals with Disabilities Act making children with disabilities able to get a free public education just like children without a disability. The IDEA gives millions of federal dollars to state schools and communities to provide education for students with different degrees of disabilities that are in special education. This is also known as Free Appropriate Public Education (FAPE).
FAPE is offered to children with disabilities for public preschool, elementary, and secondary school that meets the states curriculum and requirements at no cost to parents. The school system is responsible for identifying all the students with disabilities. Children with disabilities are put into a "Least Restrictive Environment" or LRE which means an environment where all children are alike and they can succeed the most.
Some disabilities children can have to qualify for the act is: mental retardation, hearing impairment, speech impairment, emotional disturbance, orthopedic impairment, autism, traumatic brain injury, and learning disabilities.
What did we believe before?
Children with disabilities should have to pay to get the help they need.They were sent to intstatutions or to regular school, where they wouldnt learn as much as the other students. Children with disabilites were often put into institutions and dehumanized.
What we believe after?
Children with disabilities need individualized help to learn and it should be free to all. We need to treat all children with the help they need. Everyone is entitlied to an education, some people may just need more help than others.
How do schools still act as if we have the “old” belief?
All public schools are federally funded to offer children with disabilities a free education that meets the state guidelines. We put chilren with special needs in thier own classrooms away from everyone else in most cases.
